09 December 2010 - The provisions of the Digital Economy Act 2010 (the "Act") as they relate to online copyright infringement face an uncertain future in light of the High Court's decision in November to grant permission for a judicial review on the application of two of the UK's largest ISPs, BT and TalkTalk. Meanwhile, the Parliamentary Culture, Media and Sport Committee, which announced an inquiry in November into the implementation, practicality and likely effectiveness of the Act, has been forced to postpone its inquiry pending the outcome of the judicial review proceedings.

26 November 2010 - A team at Olswang has advised fully listed client Chrysalis plc on the terms of a recommended cash offer for its entire share capital from a wholly-owned subsidiary of BMG Luxco, a joint venture between Bertelsmann and an affiliate of US private equity house Kohlberg Kravis Roberts. It is intended that the Acquisition be implemented by scheme of arrangement. Under the terms of the scheme, Chrysalis Shareholders will receive 160 pence in cash for each share held and the acquisition values Chrysalis at approximately GBP 107.4 million.

Tackling online piracy: Government responds on cost-sharing proposals

24 September 2010 - The Digital Economy Act 2010 (the "Act") placed certain obligations on internet service providers ("ISPs") aimed at reducing the online infringement of copyright. In March 2010, the Government consulted on how the costs relating to these obligations were to be apportioned between the ISPs, the copyright owners and, in the case of subscriber appeals, the subscriber concerned. On 14 September 2010, the Government published its response to the March 2010 consultation.

14 April 2010 - The Digital Economy Bill received Royal Assent on 8 April 2010. The Act introduces some, but by no means all, of the measures proposed in the Government's Digital Britain report published in June 2009. It seeks to address issues facing the media and technology industries and implements measures in respect of online copyright infringement, public service broadcasting, the regulation of video games and the UK's communications infrastructure. Certain of the measures in the Act came into effect immediately; some will be brought into force by statutory instrument at a later date, while the majority of provisions will come into force in June.
